Introduction and Acceptance

The material on the Integrated Terrorism Assessment Centre (ITAC) secured Web Portal (“Portal”) is provided to facilitate the sharing of ITAC’s information with authorized users from government, first responders and private sector stakeholders. 

This Terms of Use Agreement (“Agreement”) is a legal agreement between you and ITAC.  This Agreement sets out the terms and conditions under which you may access and use the Portal and all materials displayed, or made available through it.  By accessing and using the Portal, you are indicating that you accept to be bound by the terms and conditions of this Agreement. 

Portal Account and User Responsibilities

Registration - To use the Portal’s features, you will be required to create an account.  In creating an account, you agree to: i) provide true, accurate, current and complete information; ii) maintain and promptly update the information to ensure it remains true, accurate, current and complete; iii) identify the professional credentials associated with your organization.

User Names and Passwords – You are responsible for maintaining the confidentiality of the password you use in association with your Portal account.  You are also responsible for all activities associated with your user name and password.  ITAC retains the absolute right to suspend, restrict or terminate Portal accounts and access where it believes that a user name has been shared or used in contravention of this agreement.  You agree to notify ITAC immediately at ITAC1@smtp.gc.ca if you become aware or suspect any unauthorized use of your user name and/or password or if you suspect any other kind of unauthorized use or security breach has occurred. 

Agreed Purposes

Subject to these Terms and Conditions and/or to any instructions, conditions, notices and disclaimers on the Portal or that may be issued to you by ITAC, you may use this website and its contents within your organization only. The documents posted to the Portal are derived from various sources, including foreign partners, and are being provided to your organization in confidence. Information contained in any document is effective as of the date of publication and is not continuously updated.

Limited Access

Subject to the terms and conditions of this Agreement, you are granted access to view and use the Portal and its contents, for your professional, non-commercial use within your organization.  Access to the Portal for any other purpose is prohibited.  You are granted the right to download, store and/or print copies of the content in this context, provided that you respect all copyright and other notices contained in such content.   You must also abide by any additional requirements governing the use of any special content that may be set out in the Portal.  In the event of a conflict between the terms of use governing a particular content and this Agreement, the terms of access governing the particular content will govern. ITAC also reserves the right at any time to revoke access to the Portal and its contents at any time.

Data Protection / Confidentiality

You undertake to treat as confidential all of the content included on the Portal and to take all necessary actions to ensure that this confidentiality is preserved.  You agree to share the confidentiality requirement contained herein with those you share content from the Portal. Any sharing of content within your organization will be done so on a Need-To-Know basis.  

Governing Law and Forum

You agree that all matters relating to your access and use of the Portal and its contents shall be governed by the laws of the Province of Ontario and the laws of Canada as applicable.  You agree and hereby submit to the exclusive jurisdiction of the courts of the Province of Ontario, or the Federal Court of Canada (as applicable), with respect to all matters relating to your access and use of the Portal and the contents as well as any dispute that may arise therefrom.

No Representations and Warranties

Although ITAC monitors the quality of the information available on this Portal and updates the information regularly, the Portal and its contents are provided on a “as is” and “as available basis”.  To the maximum extent permitted by law, the Government of Canada, including ITAC, make no representations, warranties, whether express or implied, regarding the Portal and its content, including without limitation, no representations or warranties that: i) the content contained in or made available through the Portal will be of merchantable quality and/or suitable for your requirements; ii) the Portal or its contents will be accurate, complete, current, reliable, or timely; iii) the operation of the Portal will be uninterrupted or error free; iv) defects, in the operation or functionality of any software provided to you as part of the Portal, will be corrected.  Any material downloaded or otherwise obtained through the use of the Portal is at your own discretion and your own risk.    

Limitation of Liability

The Government of Canada, including ITAC, will not be liable to you under any cause of action arising from the operation of this Portal, whether based on breach of contract, or tort (including negligence), product liability or otherwise. This disclaimer extends to any direct, indirect, incidental special, consequential or exemplary damages that may be incurred by you, including loss of data.  

Changes to Terms and Conditions

ITAC may revise and update this Agreement at any time, in which case you will be notified of such changes by   way of an on-line notice at logon.  Use of the Portal after such changes are posted will indicate your acceptance of the revised terms.

Account De-activation Policy

If, for any reason, a user or an organization wishes to have an account de-activated and removed from the server, a request should be sent to ITAC1@smtp.gc.ca. Upon verification of credentials, the access for the account will be revoked.

Termination

Your access to and use of the ITAC Password-Protected Website may be terminated immediately and without notice if you breach any of the terms and conditions of this Agreement.

ITAC may also at any time and at its sole discretion terminate access to the Portal.

Privacy Notice / Use of Information

ITAC is committed to respecting the personal privacy of individuals who visit the Portal. Personal information collected by ITAC will be strictly limited to the name, user name, organization, telephone number and e-mail address of the user. All personal information you provide is protected under the Privacy Act.

The information we collect, store and disclose relating to you is used to enable us to:

  • provide ITAC products to you;

  • notify you about any changes to our website which may affect our service;

  • survey the level of aggregate user interest in documents posted to our website.

By accepting this Agreement, you consent to the collection, use, disclosure and retention of your personal information in accordance with these terms and conditions.

Third Party Material

ITAC accepts no legal liability whatsoever with respect to such third party content.

The content of outside links or third party content may not be accessible to person with disabilities and may not be available in both official languages.
